1. Seller Information
These Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern sales made through the Japanese Linocut® website and, where applicable, orders placed directly with Japanese Linocut®.

The website sells, in particular, handmade linocut prints, art prints and artistic creations, gift vouchers and linocut workshops.
These Terms and Conditions apply to consumers, i.e. natural persons acting for purposes outside their trade, business or profession.
By placing an order, the customer accepts the version of these Terms and Conditions applicable on the date of the order.
2. Product Characteristics
The essential characteristics of the products and services are described on the relevant product or service pages before an order is placed.
The linocut prints offered by Japanese Linocut® are handmade creations produced using a manual printing process.
Due to their handmade nature, slight variations in ink coverage, colour, positioning or printing may occur from one print to another. Such variations are inherent to the handmade process and do not, in themselves, constitute a lack of conformity where they are consistent with the characteristics normally expected and the information provided to the customer.
Photographs are taken with the aim of representing the artworks as accurately as possible. However, colours may appear slightly different depending on the settings and screen used.
3. Prices
Product prices are displayed in the currency applicable to the delivery country selected by the customer:
in euros (EUR) for orders delivered to France;
in Swiss francs (CHF) for orders delivered to Switzerland.
The prices displayed to the customer at the time of ordering are those applicable to the sale, inclusive of all taxes where applicable.
Any delivery charges are shown separately before the order is finally confirmed.
Japanese Linocut® reserves the right to change its prices at any time. The applicable price is the price displayed to the customer when the order is confirmed.
4. Orders
The customer selects the products or services they wish to purchase and adds them to their shopping cart.
Before finally confirming the order, the customer may review the shopping cart, correct any errors and view the total price of the order and any applicable charges.
Final confirmation of the order entails an obligation to pay.
The customer acknowledges having read and accepted these Terms and Conditions before completing the order.
An order confirmation is sent to the customer by email.
Japanese Linocut® reserves the right to refuse or cancel an order in the event of fraud or attempted fraud, a payment incident, or a previous dispute relating to payment for an order, subject to applicable law.
5. Payment
Payment is made using the payment methods offered on the website at the time of ordering, including bank card or PayPal.
The order is considered final once payment has been confirmed, subject to the provisions relating to the right of withdrawal.
Electronic transactions recorded by payment service providers may be used as evidence of transactions carried out, in accordance with applicable rules.
6. Availability
Products are offered subject to availability.
If, in exceptional circumstances, a product becomes unavailable after the order has been confirmed, Japanese Linocut® will inform the customer as soon as possible.
If the customer does not accept an alternative solution, any amount paid for the unavailable product will be refunded.
7. SHIPPING AND DELIVERY
7.1 Delivery Areas
The Japanese Linocut® online shop delivers directly to France and Switzerland.
The destinations actually available are those offered to the customer during checkout.
For certain other international destinations, Japanese Linocut® products may be available through the Japanese Linocut Etsy shop. Sales made through Etsy are subject to the terms and conditions applicable on that platform.
7.2 Order Preparation
Products in stock are normally dispatched within a maximum of four business days from confirmation of the order, unless a different timeframe is stated on the product page or before the order is placed.
During holiday periods or in certain exceptional circumstances, preparation times may be extended. Customers will be informed of this on the website or when placing their order.
7.3 Delivery Methods
For deliveries within France, orders are shipped in particular via La Poste, using Colissimo or tracked letter services, depending on the characteristics of the shipment.
For Switzerland, orders may be shipped by Chronopost Express on a DDP (“Delivered Duty Paid”) basis. Where this shipping method is used, Japanese Linocut® covers the duties, import taxes and customs clearance charges in accordance with the conditions stated when the order is placed.
The delivery times communicated to the customer are those applicable to the selected delivery method.
7.4 Receipt and Damaged Parcels
Customers are encouraged to check the condition of the parcel and products upon delivery.
In the event of damage, customers are advised to take photographs of the parcel, shipping label, packaging and affected product and to contact Japanese Linocut® as soon as possible.
Failure to make reservations or report damage to the carrier does not deprive consumers of their statutory rights, including their rights under the legal guarantee of conformity.
The risk of loss or damage passes to the consumer when they, or a third party designated by them, physically take possession of the goods, in accordance with applicable law.
7.5 Incorrect Address and Unclaimed Parcels
The customer is responsible for ensuring that the delivery address provided is accurate.
Where a parcel is returned to Japanese Linocut® because the customer provided an incorrect or incomplete address, or because the parcel was not collected within the period specified by the carrier, a new shipment may be offered.
The customer may be charged the cost of reshipping the order, unless the return was caused by an error attributable to Japanese Linocut® or the carrier.
8. RIGHT OF WITHDRAWAL – SALE OF GOODS
8.1 Withdrawal Period
In accordance with the French Consumer Code, consumers have 14 days from receipt of the goods to exercise their right of withdrawal, without having to provide a reason.
Where an order contains several goods delivered separately, the withdrawal period runs from receipt of the last relevant item.
8.2 Exercising the Right of Withdrawal
Consumers may exercise their right of withdrawal using the form provided at the end of these Terms and Conditions or by making any other unambiguous statement expressing their decision to withdraw.
No return authorisation number or prior approval from Japanese Linocut® is required in order to exercise the statutory right of withdrawal.
Consumers may also use the online withdrawal functionality made available on the website in accordance with applicable regulations.
Where withdrawal is submitted using this functionality, an acknowledgement of receipt will be sent to the consumer on a durable medium.
8.3 Returning the Product
After notifying Japanese Linocut® of their decision to withdraw, the consumer has 14 days to return the goods to:

The direct cost of returning the goods is borne by the consumer.
Consumers are encouraged to package products carefully to prevent damage during transport.
Customers are advised to retain proof of shipment.
The consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning.
Opening the parcel or reasonably inspecting the artwork therefore does not automatically result in the loss of the right of withdrawal.
8.4 Refunds
Where the right of withdrawal is validly exercised, Japanese Linocut® will refund all payments received, including the initial standard delivery charges, no later than 14 days from the date on which Japanese Linocut® is informed of the consumer’s decision to withdraw.
Japanese Linocut® may withhold the refund until the goods have been received back or until the consumer provides evidence that the goods have been sent back, whichever occurs first.
Refunds are made using the same payment method used for the original transaction, unless the consumer expressly agrees to another method that does not result in any additional cost.
Additional costs resulting from the customer’s choice of a delivery method more expensive than the standard delivery method offered will not be refunded.
9. LINOCUT WORKSHOPS
Japanese Linocut® offers linocut workshops and classes, including group and private workshops.
The characteristics of the workshop, its duration, price, number of participants and, where applicable, its date are provided before booking.
Where a workshop constitutes a leisure activity to be provided on a specific date or during a specific period, the statutory 14-day right of withdrawal does not apply, in accordance with Article L.221-28 of the French Consumer Code.
The absence of a statutory right of withdrawal does not prevent Japanese Linocut® from offering its own rescheduling or cancellation options, where such options are communicated to the customer at the time of booking.
If a workshop is cancelled by Japanese Linocut®, the customer will be offered, depending on the circumstances, either an alternative date or a refund of the amount paid for the cancelled service.
10. GIFT VOUCHERS
The specific conditions applicable to each gift voucher, including its value, validity period and the products or services for which it may be used, are stated at the time of purchase.
Where a gift voucher is purchased remotely and no statutory exception applies, the consumer benefits from the right of withdrawal provided for under the French Consumer Code.
The conditions of use and validity period stated on the voucher or its product page must be observed.
11. STATUTORY GUARANTEES
Japanese Linocut® is bound by the statutory guarantees applicable to goods sold to consumers, including the legal guarantee of conformity and the legal guarantee against hidden defects.

Mandatory French statutory notice
« Le consommateur dispose d’un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d’apparition d’un défaut de conformité. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité et non la date d’apparition de celui-ci.
Lorsque le contrat de vente du bien prévoit la fourniture d’un contenu numérique ou d’un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d’apparition de celui-ci.
La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.
La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d’une extension de six mois de la garantie initiale.
Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.
Le consommateur peut obtenir une réduction du prix d’achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu’il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n’est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n’a pas droit à la résolution de la vente si le défaut de conformité est mineur.
Toute période d’immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu’à la délivrance du bien remis en état.
Les droits mentionnés ci-dessus résultent de l’application des articles L. 217-1 à L. 217-32 du code de la consommation.
Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d’un montant maximal de 300 000 euros, qui peut être porté jusqu’à 10 % du chiffre d’affaires moyen annuel (article L. 241-5 du code de la consommation).
Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien. »

12. INTELLECTUAL PROPERTY
Purchasing a Japanese Linocut® artwork transfers only ownership of the physical copy purchased.
It does not transfer any intellectual property rights relating to the artwork.
The linocut prints, art prints, illustrations, photographs, texts, drawings, logos, graphic creations and other works displayed on the website are protected under the French Intellectual Property Code.
Japanese Linocut® is a member of ADAGP for the management of rights relating to the relevant works.
Any reproduction, representation, adaptation, distribution or commercial exploitation of an artwork, including printing it on products, paper materials, textiles, audiovisual content or digital media, is prohibited without the prior authorisation of the rights holder.
The purchase of an original artwork or print therefore grants the customer no right to reproduce or commercially exploit the artwork.
13. LIABILITY
Japanese Linocut® is responsible for the proper performance of its obligations in accordance with applicable law.
However, Japanese Linocut® shall not be held liable for failure to perform or delay resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.
Nothing in these Terms and Conditions may limit or exclude any mandatory rights granted to consumers by law.
14. FORCE MAJEURE
Where an event of force majeure temporarily prevents performance of the contract, the affected obligations may be suspended for the duration of the impediment in accordance with applicable law.
Where the impediment becomes permanent and makes performance impossible, the relevant contract may be terminated and any amounts paid for services or goods that can no longer be provided will be refunded in accordance with applicable provisions.
15. PERSONAL DATA
Personal data collected when an order is placed is used in particular for managing orders, payments, deliveries, invoices, customer relations and Japanese Linocut®’s legal obligations.
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.
Detailed information regarding the purposes and legal bases of processing, data retention periods, recipients of personal data and data subjects’ rights is provided in the Privacy Policy available on the Japanese Linocut® website.

17. APPLICABLE LAW AND DISPUTES
These Terms and Conditions are governed by French law.
This provision does not deprive consumers residing in another country of any mandatory consumer protection provisions applicable to them under the law governing their situation.
In the event of a dispute, the parties are encouraged to seek an amicable solution first.
If no amicable solution or mediation can be reached, the consumer may bring the matter before the competent court in accordance with applicable legal rules.
18. AMENDMENTS TO THESE TERMS AND CONDITIONS
Japanese Linocut® may amend these Terms and Conditions, in particular to reflect changes in legislation, regulations or the services it provides.
The Terms and Conditions applicable to an order are those accepted by the customer at the time the order is placed.
