The general terms and conditions of sale below detail the rights and obligations of the micro enterprise Japanese Linocut and its customer in connection with the sale of products present in the store https://www.japanese-linocut.com as well as orders placed between the customer and Japanese Linocut by e-mail via the “contact” section.
The parties agree that their relationship shall be governed exclusively by this Agreement, to the exclusion of all other terms and conditions. Any order duly validated on the Japanese Linocut store implies total and unconditional acceptance of these terms and conditions of sale. The general terms and conditions of sale may be modified by the publisher. The applicable conditions will be those in force on the site at the time of the validation of the order.
Prices and orders
Every purchase on the Japanese Linocut web store follows the same procedure. The customer clicks on “add to cart” the items he wants to buy. By clicking on the icon representing a basket, the customer accesses the products he wishes to buy to which will be added the shipping costs, which are fixed according to the place of delivery defined in the section provided for this purpose. He then continues the purchase process, paying either by PayPal or credit card.
Any unpaid order will be considered pending and entitled to be cancelled, if payment is not made within 10 days of the order and outside of any individual arrangement with Japanese Linocut.
SIGNATURE AND PROOF: For any payment by credit card on the Japanese Linocut website, the electronic certificate issued by the telepayment manager will be considered as proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 and following of the French Civil Code, as well as the electronic archiving means put in place by Japanese Linocut In this respect, the dates and times of the server will be binding between the parties. In any case, the validation of the order is worth signature and express acceptance of all the operations carried out on the site.
Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of Japanese Linocut until full payment of their price by the customer. In case of non-performance of its obligations by the customer, whatever the cause, Japanese Linocut will be entitled to demand the immediate return of the products at the customer’s expense and risk.
The items sold on the website https://japanese-linocut.com must not be used for commercial purposes such as: Prints on products offered for sale, paper, fabrics, videos or other media, use for media intended to promote another person than Japanese Linocut under the intellectual property and image rights (Article L 122-4 of the Code of Intellectual Property).
Product availability
The products are visible on the site while stocks last.
Any claim by the customer for the ordering or delivery of an unavailable item will be considered unfounded. In the case of a validated order for a product or item that has become unavailable, Japanese Linocut will, if no alternative solution has been agreed with the customer, not debit the customer’s account associated with the credit card number provided. In the event of a charge or collection for an unavailable item, Japanese Linocut will, within 10 days, refund the customer the amount of the order. In all cases, Japanese Linocut will notify by email any customer who has placed an order for an unavailable item. Orders are processed after validation of payment.
Shipping and delivery
Delivery areas
Our online shop delivers exclusively to France and Switzerland. Any order with a delivery address outside these territories cannot be processed.
This restriction stems from recent changes to European regulations on packaging and packaging waste, in particular European Regulation 2025/40, which comes into force on 12 August 2026.
These new rules entail specific procedures depending on the destination country. In order to ensure compliance with the regulations whilst preserving the artisanal nature of our small business, we have chosen to limit orders placed directly on our website to France and Switzerland.
This decision therefore does not reflect a lack of desire to offer our creations internationally, but rather a commitment to strictly comply with the applicable regulations.
For the United States, the United Kingdom and certain other international destinations, we invite you to place your orders via our Etsy shop.
Order fulfilment
Items in stock are dispatched within a maximum of four working days from the date of order confirmation, unless a different timeframe is expressly stated on the product page.
If it is not possible to meet this deadline, Japanese Linocut will inform the customer by email as soon as possible.
During holiday periods, the preparation time may be extended. The relevant dates and the applicable timeframe will then be indicated on the website before the order is confirmed.
Delivery methods
For orders to France, delivery is carried out by La Poste, via Colissimo or Lettre suivie, depending on the weight and volume of the items.
For orders to Switzerland, delivery is carried out by Chronopost Express on a DDP (‘Delivered Duty Paid’) basis. Any applicable duties, import taxes and customs clearance fees are covered by Japanese Linocut. The customer should not be asked to pay these charges upon delivery.
Delivery times are specified to the customer at the time of ordering. These may be extended due to customs procedures or circumstances beyond Japanese Linocut’s control. In the event of any difficulties, Japanese Linocut remains the customer’s point of contact regarding the tracking and successful completion of the delivery.
Delivery and damaged parcels
Customers are asked to check the condition of the parcel and the products upon receipt.
If the parcel or its contents are damaged, the customer may refuse delivery or make specific reservations with the carrier. They are also asked to contact Japanese Linocut as soon as possible, attaching, where possible, photographs of the parcel, its packaging and the products concerned.
Failure to make a formal complaint to the carrier does not deprive the consumer of their legal rights, in particular the statutory guarantee of conformity.
The risk of loss or damage to the products passes to the customer at the moment when they, or a third party designated by them, take physical possession of the order.
Delivery address and returned parcels
Customers must carefully check that the delivery address provided when placing an order is accurate and complete, particularly when using PayPal or a payment method with a pre-registered address.
Where a parcel is returned to Japanese Linocut due to an incorrect or incomplete address provided by the customer, or because the parcel has not been collected within the timeframe specified by the carrier, Japanese Linocut will inform the customer.
A new dispatch may be arranged once the new delivery charges have been paid. These charges will not be applied if the return is due to an error on the part of Japanese Linocut or the carrier.
Force majeure
Japanese Linocut shall not be held liable for any delay or failure to perform resulting from an event of force majeure within the meaning of Article 1218 of the Civil Code.
In the event of a temporary impediment, fulfilment of the order shall be suspended for the duration of the event. If the impediment becomes permanent and renders delivery impossible, the order will be cancelled and any sums paid will be refunded to the customer.
Other international destinations
For orders to the United States, the United Kingdom or other countries outside the European Union available for international delivery, customers are invited to place their orders via our Etsy shop.
Orders to Switzerland can still be placed directly via our website.
At the time of payment, Etsy collects the taxes that the platform is legally required to collect. Shipments are made on a DDP basis via Chronopost Express where this option is available for the destination in question. Any import duties and taxes not already collected by Etsy are then covered by Japanese Linocut.
European Union countries
With the exception of France, we are currently unable to accept orders for delivery to other European Union countries, whether via our website or our Etsy shop.
This restriction is due to new packaging requirements applicable to cross-border sales within the European Union. We hope to be able to offer these destinations again if the procedures are simplified in the future.
Orders placed on Etsy remain subject to the terms and conditions and information displayed on that platform at the time of purchase.
Withdrawal and warranty
In accordance with the provisions of Articles L.121-20 and following of the Consumer Code, the customer has 7 days from the date of delivery to return the product in its original packaging. The return will only be accepted if the product has not been unpacked / used. All returns must be preceded by Japanese Linocut’s prior approval and the assignment of a return number. The returns must imperatively be addressed to : 163, chemin de Rollion 01800 Saint Jean de Niost, Ain (01), France.
In the absence of a prior agreement, of attribution of a return number or in case of sending to any other address, the goods will be returned to the customer with postage due. Returned products must be accompanied by their original packaging. This right of withdrawal is exercised without penalty, with the exception of transport costs, which remain the responsibility of the Customer. In the event of the exercise of the right of withdrawal, the Customer will receive a credit note of the sums paid to be used on a future order. The Customer may also request a refund of the amounts paid. In the event of a refund request, Japanese Linocut will make every effort to refund the Customer within 30 days of the date the Customer exercised his right of withdrawal (Article L121-20-1 of the Consumer Code).
Limitation of liability
The information given on the site, photographs, product sheets, prices, texts, are given as an indication. Japanese Linocut makes every effort to ensure the accuracy of the information presented on the site. Any errors that may have been introduced are fortuitous and will be rectified as soon as possible. Japanese Linocut cannot be held responsible for simple errors or omissions that may occur despite all precautions taken in the presentation of the products.
Legal information
The personal information relating to the customer is essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. Failure to provide this information will result in the non-validation of the order. The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise to Japanese Linocut.
Commitment to data protection
In accordance with the provisions of Law No. 98-536 of July 1, 1998, transposing into the code of intellectual property of Directive 96/9/EC of March 11, 1996, concerning the legal protection of databases, Japanese Linocut is the producer and owner of all or part of the databases comprising this site. By accessing this site, the customer acknowledges that the data it contains is legally protected and, in accordance with the provisions of the aforementioned law of July 1, 1998, is prohibited from extracting, reusing, storing, reproducing, representing or preserving, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or part, qualitatively or quantitatively substantial, of the content of the databases appearing on the site he/she is accessing.
Applicable law
This contract is subject to French law.
